Judge Rejects Merck Motion for Mistrial 
Merck & Co. unsuccessfully appealed to a judge Friday to declare a mistrial in the case of two men who blame their heart attacks on Vioxx. The company had claimed a plaintiff's attorney tried to influence the jury by disclosing that his client had written letters to jurors thanking them for their service.
